Our work in the field of insurance sales law(VVG)

• We check and draw up brokerage agreements and cooperation agreements with brokers, representatives and multiple agents
• We advise insurance companies and sales persons during the term of a contract about compensation, termination and indemnity of brokers
• We take care of the settlement of terminated brokerage agreements. This includes issues like reclaiming unearned commissions and broker's fees, claims to compensation, retirement benefits, statements of commission accounts
• We clarify liability issues in sales in the case of fraudulent brokers or misselling

By means of the German Insurance Contract Law that came into force on 22nd May 2005, the Federal Republic of Germany belatedly implemented the EU Directive on Insurance Mediation (2002/92/EG). New regulations were added to the German Insurance Contract Law (VVG), which bring a clear definition for the types of brokers. In the future, the VVG will separate insurance intermediaries into insurance agents and insurance brokers.

The insurance agent is an agent representing the interests of the insurance company according to § 84 ff. German Commercial Code. Fundamentally he is obliged to give advice, however he only has to fall back on those insurance companies he is contractually obliged to. These insurance companies must be named.

The insurance broker is basically active on behalf of the client and is assigned to his sphere of interest. He is obliged to recommend the insurance suitable for fulfilling the client's needs and requirements from a sufficiently large number of insurance companies and insurances. He has to give reason for his advice. The insurance broker usually works in the scope of a brokerage agreement. The brokerage agreement regulates to what extent the power of attorney covers representation and to what extent the selection of the insurance should be carried out.
