Drawing up a prenuptial agreement

You are considering whether you need a prenuptial agreement before you get married or a marriage agreement whilst married? Does this mean the announcement of a later divorce?

A prenuptial agreement is always sensible if, for example,

• Differential financial circumstances exist between the partners before or during marriage
• A company exists, which should not be destroyed by a divorce
• A partner deliberately abstains from working but does not want to be fundless in the case of a divorce
• In the case of a second marriage, the assets from a previous relationship should not flow in
• Children from the first marriage should be secured after the death of a biological parent

Thus, there are several reasons for signing a prenuptial agreement. Likewise, there are a variety of aspects to be considered when drawing up an agreement. That is why we advise you not to use model contracts. For: every marriage is unique, which is why no prenuptial agreement is the same as another one. Yet, there are (constitutional) limits to the freedom of a contract. In such an agreement, (financial) aspects concerning property can be regulated.
