Checklist for employers

For employers who intend to give notice of termination

Before giving notice, you should at least check the following points:

  • Does the Employment Protection Act apply to the contract of employment to be cancelled?
  • Are the facts sufficient for an extraordinary, termination without notice for cause or a proper notice of dismissal?
  • Which term of notice applies? This depends on the employment contract, possible applicable collective agreements and the law.
  • Does protection against termination for good cause apply (e.g.: works council member, mothers-to-be, the severely disabled, employees on parental leave? Are special preliminary proceedings necessary (e.g. obtaining approval from the Equal Employment Opportunity Commission in the case of the severely disabled)?
  • How must proper participation of a works council member of the employer's company take place? Is only a hearing or approval by the works council necessary?
  • Does the company have any counterclaims (e.g. employer loan, return of tools, etc.)?
  • What should the notice contain and in which form should it be?
  • What must you point out to the employee separately?
  • How should the employee receive the notice?
  • How likely is a tribunal dispute concerning the effectiveness of the notice?
  • What risks are involved in a complaint of unfair dismissal? To what extent should possible risks be discussed (especially in financial terms)?
  • Should the employee be declared exempt from the obligation to work?
