Frequently asked questions regarding legal protection insurance in mandate
Does legal protection insurance also cover my case?
The fact that a legal protection insurance contract has been concluded does not guarantee that the insurance company will actually cover the costs of a lawyer. Whether your insurance is obliged to cover the costs and to what extent, can be taken from the General Terms of Legal Protection Insurance agreed upon between you and the insurance company. A general answer to this question is thus not possible, as every insurance relationship is based on the terms of contract. They are indeed all very similar, but differ in the important details.
The question about coverage can usually not be answered until after describing the facts. You receive coverage or insurance protection for the legal protection insurance if a case of legal protection occurs within the period of insurance in the fields properties and types of performance that were contractually agreed upon, does not represent an excepted legal issue and reveals chances of success for each level of the proceedings.
Does legal protection insurance pay for my lawyer's fees?
Legal protection insurance covers lawyer's fees according to the Lawyer Fees Act. Whether these are sufficient in your case, can only be clarified in a personal appointment (compare with this the page on Fees). In addition, it also depends on the individual insurance company, to what extent travel costs, costs for copies, costs for sending files, for doctor's notes, etc. are covered. So you have to expect that such additional charges will not be borne by the insurance company.
For reasons of practicability, we have to refuse a mandate that it is given on the presumption that legal protection insurance will cover all costs. This is not feasible for us.
Does the lawyer's office take care of my legal protection insurance during the mandate?
As long as a legal protection insurance agreement exists, we are
glad to enquire about the question of coverage after giving
us the mandate. This is a part of our service and does
not entail additional costs. By the same token, we send copies of
notes of fees as agreed to the insurance company with the request
to pay. This service is also free of charge. A contractual commissioning
of enforcing your interests against the legal protection insurance
company is not included in the mandate.
Should the legal protection insurance company refuse to promise full
coverage or to pay the notes of fees invoiced, then we will contact
the insurance company in writing on your behalf and mention this possibly
raised question. Should the desired willingness to pay still not exist,
our office can no longer give legal advice for free. We then have
to request you to pay.
Consequently, the service offered by our office regarding the settlement
of costs through the legal protection insurance company ends here.
It would be our pleasure to represent you with respect to your insurer
in the scope of a separately (charged) awarded mandate.
